Unlicensed use is unauthorized. You agree not to display, “frame,” make derivative works, distribute, license, or sell content from AST, excluding postings you create. Additionally, you grant us a perpetual, irrevocable, unlimited, worldwide, fully paid/sublicensable license to use, copy, display, distribute, and make derivative works from the content you post.

USE:

Unless specifically licensed by us in a separate written or electronic agreement, you agree not to use or provide software (except our App and general-purpose web browsers and email clients) or services that interact or interoperate with AST. This includes actions such as downloading, uploading, creating/accessing/using an account, posting, flagging, emailing, searching, or mobile use. You further agree not to copy/collect AST content via robots, spiders, scripts, scrapers, crawlers, or any automated or manual equivalent. Misleading, unsolicited, and/or unlawful postings/communications/accounts are strictly prohibited, as is the buying or selling of accounts.

You agree not to post content that is prohibited by any of AST’s policies or rules. You also agree not to abuse AST’s flagging or reporting processes. Collecting AST user information or interfering with AST is not allowed. We reserve the right to moderate AST access/use in our sole discretion, which may include blocking, filtering, re-categorizing, re-ranking, deleting, delaying, holding, omitting, verifying, or terminating your access/license/account. You agree (1) not to bypass said moderation, (2) acknowledge that we are not liable for moderating or not moderating, and (3) understand that nothing we say or do waives our right to moderate or not.

(iv) circumvent any functionality that controls access to or otherwise protects AST or the API, or
(v) remove or alter any copyright, trademark, or other proprietary rights notices.

You further agree not to use AST or the API in any manner or for any purpose that infringes, misappropriates, or otherwise violates any intellectual property right or other right of any person, or that violates any applicable law.

All Signs Tarot LLC – Liquidated Damages and Fees:

You acknowledge and agree that by violating the Terms of Use (TOU) of All Signs Tarot LLC, or by encouraging, supporting, benefiting from, or inducing others to do so, you will be jointly and severally liable for liquidated damages as outlined below:

(A) Collecting/Harvesting User Information: $2 per violation.

(B) Publishing/Misusing Personal Information: $2,000 per violation without express written consent.

(D) Posting Prohibited Content: $8 per violation.

(E) Posting Prohibited Content in Paid Section: Price per post applicable to that section.

(F) Sending Unauthorized/Unsolicited Email: $50 per violation.

(G) Unauthorized/Unsolicited Text Message/Call/Communication: $1,000 per violation.

(H) Creating a Misleading or Unlawful Account: $8 per violation.

(I) Abusing Flagging or Reporting Processes: $2 per violation.

(J) Distributing Software for Violations: $2,000 per violation.

(K) Exploiting CL Content without Consent: $6,000 for each day of violation.

(L) Exceeding Page Access Limit: $0.50 per page beyond 1,000 pages in a 24-hour period.

(M) Bypassing Moderation Efforts: $8 per violation.

You agree that these amounts represent a reasonable estimate of damages, are not a penalty, and do not limit our ability to recover under any legal theory or claim. Repeated violations may result in irreparable harm, entitling us to injunctive or equitable relief, in addition to monetary damages.

FEES:
When making a paid posting on All Signs Tarot LLC, you authorize us to charge your account. Fees, as outlined in our Posting Fees, are non-refundable, even if posts are removed, delayed, omitted, re-categorized, re-ranked, or otherwise moderated. We reserve the right to refuse any posting.

All Signs Tarot LLC – MISC:

Unless you have entered into a separate written or electronic agreement with All Signs Tarot LLC that expressly references the Terms of Use (TOU), the following terms constitute the exclusive and entire agreement between us and you, superseding all prior and contemporaneous understandings, agreements, representations, and warranties, both written and oral. Users complying with prior written licenses may access All Signs Tarot (AST) until authorization is terminated.

Our actions or silence toward you or anyone else do not waive, modify, or limit the TOU or our ability to enforce it. The USE, LIQUIDATED DAMAGES, and CLAIMS & INDEMNITY sections survive termination of the TOU, and you will remain bound by those sections.

If a TOU term is deemed unenforceable, it shall be limited to the least extent possible and supplemented with a valid provision that best embodies the intent of the parties. The English version of the TOU controls over any translations.
